CONFIRMATION OF COMPLIANCE

In the Republic of Belarus and the Eurasian Economic Union (EAEU) provide for the following main forms of conformity assessment:

a form of mandatory conformity assessment carried out by the manufacturer or an authorized person of the manufacturer, can be made by the seller (supplier). The applicant is responsible for the accuracy of the documents submitted. The document confirming conformity is the declaration of conformity.

a form mandatory of conformity assessment conducted by the certification body. The certification body is responsible for the accuracy of the submitted documents. in the absence of requirements, certification can be carried out voluntarily (voluntary certification).

DECLARATION OF CONFORMITY

The person responsible for the conformity of products when declaring:

  • person authorized by the manufacturer – the national representative (for manufacturers who are not legal entities of the EAU member countries and/or the Republic of Belarus);

  • the manufacturer of products is a legal entity of the EAU member countryand / or the Republic of Belarus;

  • seller (supplier) of products to the market of the EAU member country and/or the Republic of Belarus.

 

DECLARATION of conformity - a document in which the manufacturer or authorized by the manufacturer or the seller (supplier) certifies the compliance of products with the technical requirementscontained in the technical regulations of the Republic of Belarus and / or the Eurasian Economic Union (EAC), as well as regulatory legal acts The President of the Republic of Belarus or the Council of Ministers of the Republic of Belarus, providing for the introduction of mandatory confirmation of conformity in connection with the need to take prompt measures of state regulation.

Objects requiring confirmation of conformity are defined in:

 

  • EAEU Technical Regulations;

  • Technical regulations and normative legal acts of the Republic of Belarus.

 

 Declaration in the national system of the Republic of Belarus 

An applicant for declaration can only be a legal entity of the Republic of Belarus.

Documents that are required to send a sample (customs clearance)

  • a test application form;

  • sample questionnaire (when ordering delivery by the recipient);

  • a testing contract (if necessary);

  • an additional agreement for testing of a particular sample;

  • a manual or datasheet for the sample in English and Russian;

  • an invoice on sample shipment in English and Russian (the IMEI number must be specified - for GSM devices and the FSB/KGB notification number - for devices with built-in means of communication).

 

Documents that are required for compliance verification

  • a contract for payment for work between PROMERY and your company;

  • an agreement between the manufacturer and PROMERY to represent the interests of the manufacturer;

  • a TPBY labeling draft of the product;

  • a manufacturer's declaration of software versions for each integrated communication module;

  • a manufacturer's declaration on the factories of manufacturers;

  • a valid ISO 9001 or its equivalent (or production inspection report in CIG 023 form, valid for 1 year) for each factory listed in the declaration of factories;

  • the HS code of the product;

  • manual (user manual) in Russian or in English, accompanied by a manufacturer's declaration that the unit will be supplied with the manual in Russian when delivered to the territory of the EAEU .

 

 DECLARATION IN THE EAEU CONFORMITY VERIFICATION SYSTEM 

The applicant for the declaration can only be a legal entity of the country

of the EAEU member.

Requirements for the package of documents differ depending on the requirements specified in the technical regulations of the EAeu.

 

The content of technical files differs and depends on the requirements specified in technical regulations, standards and other technical regulatory legal acts, for compliance with which a particular product is evaluated.

 

In general, the following documents are required:

 

  • Application.

  • CE manufacturer's declaration;

  • Draft of EAC markings;

  • Draft of technical marking;

  • Manual (user manual) in Russian or in English, accompanied by a manufacturer's declaration that the unit will be supplied with the manual in Russian when delivered to the territory of the EAEU;

  • Valid ISO 9001 certificate for each manufacturing factory (or production inspection report on the form CIG 023, valid for 1 year);

  • Test reports performed in accredited testing laboratories of the manufacturer, international accredited testing laboratories, accredited testing laboratories of the EAEU;

  • Agreement on representation of the interests of the manufacturer in terms of confirming compliance with the requirements of the technical regulations of the EAEU;

  • Supplementary Agreement for Testing (if necessary);

  • Power of attorney from the manufacturer to carry out sampling (if necessary);

  • Contract for payment of conformity assessment services;

  • Other documents in accordance with the requirements specified in the technical regulations.

 

CERTIFICATION

The person responsible for the conformity of products during Certification:

  • accredited certification body.

 

The applicant for certification may be:

  • the manufacturer of the goods;

  • the person authorized by the manufacturer - is the national representative (for manufacturers who are not legal entities of the EAEU member states and/or the Republic of Belarus);

  • the manufacturer of the goods which is a legal entity of a member state of the EAEU and/or the Republic of Belarus;

  • seller (supplier) of products to the market of the EAEU member state and/or the Republic of Belarus.

 

certificate of conformity - a document certifying the compliance of the object of conformity assessment, with the exception of the competence of personnel in performing certain works, providing certain services, technical requirements contained in the technical regulations of the Republic of Belarus and / or the Eurasian Economic Union (EAEU) , as well as regulatory legal acts of the President of the Republic of Belarus or the Council of Ministers of the Republic of Belarus, providing for the introduction of mandatory confirmation of conformity in connection with the need to take prompt measures.

Documents that are required for compliance verification

The requirements for the package of documents differ depending on the requirements specified in the technical regulations of the EAC.

In general, the following documents are required:

  • Application. 

  • CE Declaration of Manufacturer;

  • Draft of EAC markings; 

  • Draft technical marking;  

  • Manual (user manual) in Russian or in English, accompanied by a manufacturer's declaration that the unit will be supplied with the manual in Russian when delivered to the territory of the EAEU;

  • Risk analysis (if necessary); 

  • Production inspection report form CIG 023, valid for 1 year;

  • Test protocols performed in the manufacturer's accredited testing laboratories, internationally accredited testing laboratories, EAEU accredited testing laboratories;

  • Agreement on representation of manufacturer's interests in terms of confirmation of compliance with the requirements of the technical regulations of the EAEU;

  • Supplementary agreement for testing (if required); 

  • Power of attorney from the manufacturer for sampling (if necessary);

  • Contract for payment of conformity assessment services.....

Terms and definitions

"accredited testing laboratory (centre)" – registered in the territory of a Member State in accordance with with its legislation, a legal entity carrying out research (testing) and measurements, officially recognized by the accreditation body and included in the unified register of conformity assessment bodies of the Union, or a structural unit of such a legal entity acting on its behalf;

 

"analysis of the state of production" - an element of the standard conformity assessment scheme, which is a set of actions carried out by the product certification body in order to determine whether the manufacturer has the necessary conditions to ensure constant (stable) compliance with the manufactured in circulation in the customs territory of the Union of products the requirements of technical regulations, confirmed (confirmed) during certification;

 

"single product" - a separate copy of piece products;

 

"importer" - a legal entity or an individual registered in accordance with the procedure established by the legislation of the Member State in its territory, which has concluded a foreign trade contract with a foreign manufacturer (seller) for the transfer of products, release these products into circulation and (or) sell them in the customs territory of the Union and are responsible for its compliance with the requirements of technical regulations;

 

"management system certification body" means a legal entity registered in accordance with the procedure established by the legislation of a Member State in its territory, which is a resident of that Member State and accredited by an accreditation body as a body carrying out activities for the certification of management systems;

 

"batch of products" – a set of units of production of one name and designation (if any) in accordance with with a shipping document submitted by the applicant for confirmation of conformity;

 

"periodic evaluation of certified products" - a systematic conformity assessment (inspection control) carried out by an accredited product certification body in order to establish the compliance of certified products with the requirements of technical regulations confirmed during the certification of these products;

 

"seller" – a legal entity or a natural person registered in accordance with the procedure established by the legislation of the Member State in its territory, selling products under contracts and non-manufacturers;

 

"mass production products" – products manufactured according to the same technical documentation using a single technological process and manufactured into circulation in the customs territory of the Union in the form of a successive series of units of production or periodically repeating batches of products;

 

'manufacturer's own testing laboratory' means a legal entity registered in accordance with the procedure established by the legislation of the Member State in its territory, carrying out research (testing) and measurements and owned by the manufacturer, or a structural unit of this legal entity acting on his behalf;

 

"conformity assessment scheme" - a set of procedures that are carried out when assessing the conformity of products with the requirements of technical regulations, the results of which are used to make a decision on the compliance (non-compliance) of products with the requirements of technical regulations;

 

"certification scheme" - a set of actions, the results of which are considered as evidence of product compliance with the requirements of technical regulations;

 

"shipping documents" – documents defining the nomenclature and quantity of products;

 

"manufacturer's branch" - a separate subdivision of the manufacturer, which is not a legal entity, is located outside its location and performs all its functions or part thereof.
