ANALYSIS AND EXPERTISE of documentation in order to determine the need and form of confirmation of the conformity, the need for inspections of production manufarturing, product testing and sampling requirements.

For products supplied to the territory of the Republic of Belarus and the Eurasian Economic Union (EAEU) requires documents confirming compliance with the requirements of technical regulations, state standards and other normative legal acts.

The main forms of confirmation of compliance with the requirements of technical regulations in the Republic of Belarus and the Eurasian Economic Union (EAEU) are the Declaration of Conformity , Certification of Conformity.

conformity declaring - a form of conformity assessment, conducted by the manufacturer or a person authorized by the manufacturer, can be made by the seller (supplier). The applicant is responsible for the reliability of the documents submitted. The document confirming compliance is a declaration of conformity. If there are requirements - is mandatory.

 

declaration of conformity - a document in which the manufacturer or a person authorized by the manufacturer or a seller (supplier) certifies that the products comply with the technical requirements contained in the technical regulations of the Republic of Belarus and/or the Eurasian Economic Union (EAEU), as well as regulatory legal acts of the President of the Republic of Belarus or the Council of Ministers of the Republic of Belarus, providing for the introduction of mandatory conformity confirmation in connection with the need to take operational measures of state regulation.

 

сonformity certification - a form of conformity assessment conducted by a certification body. The certification body is responsible for the accuracy of the submitted documents. The certificate of conformity is the document confirming compliance. If there are requirements, it is mandatory (mandatory certification), in the absence of requirements, it can be carried out on a voluntary basis (voluntary certification).

 

certificate of conformity – a document certifying the conformity of the object of conformity assessment, with the exception of the competence of personnel in performing certain works, rendering certain services, to the technical requirements contained in the technical regulations of the Republic of Belarus and/or the Eurasian Economic Union (EAEU), as well as regulatory legal acts of the President of the Republic of Belarus or the Council of Ministers of the Republic of Belarus, providing for the introduction of mandatory conformity assessment in connection with the need to take operational measures of state regulation.

 

Determination of the need and form of conformity assessment

The procedure of analysis and technical and expert examination of product documentation allows you to determine:

 

  • Whether there is a need to confirm compliance;

 

  • The requirements of which technical regulations (of the Republic of Belarus and/or the Eurasian Economic Union (EAEU) and regulatory legal acts apply to each type of product supplied to the territory of the Republic of Belarus and the Eurasian Economic Union (EAEU);

 

  • Form of confirmation of compliance;

 

  • Technical requirements of standards and regulatory legal acts for each type of products supplied to the territory of the Republic of Belarus and the Eurasian Economic Union (EAEU);

 

  • A list of evidentiary materials (documents) is required to confirm compliance;

 

  • Requirements for evidentiary materials (documents) to confirm compliance;

 

  • The need for testing;

 

  • Requirements for samples and documents for testing.

 

  Analysis and examination of documentation  

Analysis and examination of documentation is carried out on the basis of the following documents:

 

  • Operation manual (should include a detailed technical description of the product);

 

  • Other operational, technical and design documentation, information on materials and components (if necessary);

 

  • CE manufacturer's declaration;

 

  • Risk analysis (if necessary);

 

  • Product test reports (if necessary).

 

Block diagram analysis and examination of documentation

The analysis and examination of the documentation guarantees:

 

  • confirmation of the conformity of products to the extent not exceeding the requirements of technical regulations (of the Republic of Belarus and/or the Eurasian Economic Union (EAEU) and other regulatory legal acts;

 

  • cost savings on conducting conformity assessment and confirmation procedures;

 

  • elimination of most technical barriers when products enter the market of the Republic of Belarus and the Eurasian Economic Union (EAEU).

 

Responsibility within the framework of the national legislation of the Republic of Belarus:

 

The Code of the Republic of Belarus on Administrative Offenses, in articles 23.11 and 23.12, provides for the following penalties:

 

  • Article 23.11. Violation of the requirements for mandatory confirmation of compliance of products (works, services) with the requirements of technical normative legal acts in the field of technical normalization and standardization, technical regulations (entails a fine of up to 5,000 Euros);

 

  • Article 23.12. Violation of the requirements of the legislation on technical normalization and standardization, technical regulations (entails a fine of up to 5,000 Euros);

 

  • Note. Release into circulation means the delivery (including sale) or import (including shipping from the manufacturer's warehouse or shipment without warehousing) of products for distribution in the course of commercial activities on a free or reimbursable basis.
